The Intellectual Property Certification Committee has transmitted proposed amendments to the rules regarding IP Certification that will require IP certified lawyers to devote a minimum of 50% of their practice to IP in order to be certified or recertified.
An agenda item to discuss these proposed amendments will be added to the meeting agenda for the Business Law Section Retreat this coming weekend. Please plan to attend so that your views can be heard and considered on this important issue.

The Federal Circuit has granted the petition for rehearing en banc filed by the plaintiffs in Ariad Pharmaceuticals, Inc. v. Eli Lilly and Co. The Court has asked the parties to file briefs addressing (1) whether a written description requirement separate from an enablement requirement is contained in 35 U.S.C. 112 (1); and (2) if a separate written description requirement is set forth in the statute, what is the scope and purpose of this requirement.

The committee will meet Saturday September 5 from 9:30 – 12:00 in Port Royal during the Retreat at the Ritz Carlton Naples. You do not have to be registered for the retreat in order to attend a committee meeting.

Thanks to Jeanne Seewald for providing us with a copy of SB 872 which reinstates the requirement that a business publish its intent to use a fictitious name in a local newspaper. The publication requirement, which takes effect today, is codified in 865.09, F.S.
